Norwalk Workplace Injury Lawyer

When a person heads off to work, there is always the risk that they could end up injured that day. Many workplaces are generally safe, but not all are. Some have a ton of safety violations. Employers may cut corners when it comes to training, putting workers at risk.

A workplace accident can cause injuries to any part of the body. The head, neck, spine, and even internal organs can be injured. These injuries can affect your life in many ways. They can also be very costly, so make sure you get the compensation you deserve.

A Norwalk workplace injury lawyer from Morizio Law Firm, P.C. can assist you with your workers’ compensation claim. We’ll guide you through the process so you can obtain benefits with ease.

Can You Get Workers’ Compensation Benefits?

In order to receive workers’ compensation benefits, you must be eligible. These three elements apply:

  • Your employer carries workers’ compensation insurance. Under Connecticut law, businesses are required to carry workers’ compensation insurance if they have at least one employee. The employees’ status (part-time, full-time, etc.) is not a concern. Companies do not have to provide coverage for independent contractors.
  • You are an employee. In addition to part-time and full-time employees, temporary employees and seasonal workers are also considered employees for workers’ compensation purposes. Again, independent contractors are not considered employees. Neither are volunteers, domestic workers, and farm workers.
  • You were injured while at work. You must have been doing job duties at the time of the accident. There are some gray areas with this. For example, commuting to and from work is not considered work time, but driving to a different location to attend a meeting is.

Types of Disability Benefits

When a person is severely injured at work, they may be able to receive disability benefits. There are four types of disability benefits:

  • Temporary Partial Disability. These benefits are available to workers who are able to return to work with modifications and restrictions for the time being.
  • Temporary Total Disability. These benefits are available when a worker is totally disabled for a limited period of time.
  • Permanent Partial Disability. Employees receive these benefits if they are partially disabled and unable to work due to partial loss of the body or a body part.
  • Permanent Total Disability. An injured worker will receive these benefits if they are permanently and totally disabled and cannot work at all. In these cases, the employee may also be able to receive Social Security disability benefits.

If the worker is killed, the surviving family members are also entitled to death benefits. Death benefits serve as compensation for the loss of financial support.
